By accessing or using OwnSourceAI ("the Platform"), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, do not use the Platform.

2. Description of Service

OwnSourceAI is an AI-powered recruitment platform that enables organizations to:

Upload, parse, and organize candidate resumes
Search candidates using AI-powered natural language and parametric search
Manage jobs, folders, and candidate shortlists
Send outreach emails to candidates
Import resumes from Gmail and other sources
View talent analytics and insights

3. Account Registration

To use OwnSourceAI, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans and Usage Limits

OwnSourceAI offers multiple subscription tiers (Free, Growth, Professional, Enterprise) with varying usage limits including:

Number of resumes that can be parsed (daily and total limits)
Number of AI searches per month
Number of outreach emails per month
Number of active jobs and team members

Free tier accounts are subject to a daily upload limit of 50 files per day and 1,000 resumes lifetime. Usage limits may be adjusted at our discretion. We will notify you before any changes take effect.

5. Acceptable Use

You agree not to:

Upload or process data that you do not have the legal right to use
Use the Platform for unsolicited mass emailing or spam
Attempt to circumvent usage limits, rate limits, or security measures
Reverse engineer, decompile, or disassemble any part of the Platform
Use the Platform to discriminate against candidates based on protected characteristics
Share your account credentials with unauthorized users
Use automated scripts or bots to access the Platform without authorization

6. Data Ownership

Your Data: You retain all ownership rights to the candidate data, resumes, and content you upload to OwnSourceAI. We do not claim ownership of your data.

Our Platform: OwnSourceAI, including its AI models, search algorithms, user interface, and documentation, is our proprietary technology protected by intellectual property laws.

License:By uploading data, you grant us a limited license to process, store, index, and display your data solely for the purpose of providing the Platform's services to you.

7. Email Outreach Compliance

When using OwnSourceAI's email outreach features, you agree to:

Only send emails to candidates for legitimate recruitment purposes
Honor all opt-out/unsubscribe requests promptly
Not remove or tamper with unsubscribe links in outreach emails
Comply with the Digital Personal Data Protection Act (DPDP Act) and other applicable email regulations
Not use the email feature for marketing, advertising, or non-recruitment purposes

8. Gmail Integration

If you connect your Gmail account, you authorize OwnSourceAI to access your inbox in read-only mode to identify and import resume attachments. We comply with the Google API Services User Data Policy, including the Limited Use requirements. We do not read, store, or share email content beyond identifying resume attachments.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice for planned maintenance when possible.

10. Limitation of Liability

To the maximum extent permitted by law, OwnSourceAI and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms or engage in conduct harmful to other users or the Platform. Upon termination, your data will be retained for 30 days to allow export, after which it will be permanently deleted.

12. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Platform at least 15 days before taking effect. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
